1. Eligibility

By using TradeMakaya, you represent and warrant that you are at least 18 years old, have the legal capacity to enter into a binding agreement, and are not prohibited from using the Service under any applicable law.

2. Nature of the Service

TradeMakaya does NOT:

• Provide financial, investment, trading, or legal advice
• Recommend any financial instruments or strategies
• Execute trades or manage assets on your behalf
• Guarantee any financial outcomes or returns
• Operate as a broker or financial advisor

3. Intellectual Property

All content, trademarks, and data on TradeMakaya are the property of TradeMakaya or its licensors. You may not copy, reproduce, or distribute any part of the platform without written permission.

4. Limitation of Liability

TradeMakaya is provided "as is" without warranties of any kind. We are not liable for any losses or damages resulting from your use of the platform.

5. User Content and Data

You retain ownership of your User Content. By using the Service, you grant TradeMakaya a non-exclusive, worldwide, royalty-free license to store, process, and analyze your content within the Service.

We will not sell your individual User Content without your consent, except where required by law.

6. Acceptable Use

You agree not to use TradeMakaya to:

• Violate any applicable law or third-party right
• Upload illegal, harmful, or abusive content
• Attempt to hack or disrupt the Service
• Reverse engineer or scrape content
• Impersonate another person

7. Third-Party Services

TradeMakaya may integrate with third-party services. These are governed by their own terms and privacy policies. We are not responsible for third-party services or their availability.

8. No Warranty

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee error-free, uninterrupted, or secure service at all times. You use the Service at your own risk.

9. Liability Limits

TradeMakaya shall not be liable for any indirect, incidental, or consequential damages. Our total aggregate liability shall not exceed the amount you have paid us in the last three months.

10. Indemnification

You agree to indemnify and hold harmless TradeMakaya from any claims arising from your use or misuse of the Service, violation of these Terms, or your User Content.

11. Termination

We may suspend or terminate your access if you violate these Terms. You may stop using the Service at any time. Upon termination, your right to use the Service ends immediately.

12. Changes to Terms

We may update these Terms from time to time. By continuing to use the Service after changes become effective, you accept the revised Terms.

13. Governing Law

These Terms shall be governed by the laws of Haiti. Disputes shall be subject to the exclusive jurisdiction of the courts of Port-au-Prince.
